Just noticed the Subway cache in Rochester has been archived. Sad Sad This is ranked in my top 5 BEST caches. Smiley Smiley Smiley

Actually, I checked in with a "legal expert" friend of mine (who wishes to remain nameless).
Here's his advice...

in small claims, cheap, easy but you need some pretty solid proof
of the values of things. Get your thoughts together on what has
been lost physically and contact the DA's office at

should be polite and to the point, avoiding personal attacks and/or

it actually works.

I completely agree, and apologize if my enthusiasm for justice/payback came across
as a call for vigilantism. Collectively, the best position we can take is a polite show of
unity in the court room.  Even if the judge doesn't dish out what we'd like, it would do
good for Paul Repak to get a direct measure of the number of people he's succeeded
in deliberately annoying.  It's also good for us all to know exactly who this jerk is, photo
and all, so we can adjust reactions accordingly if we bump into him in the wild near a
cache.

Direct harassment to his property, self, or family would be way out of line.

Separately, I think the odds of us getting our "day in court" are extremely small.
My money is on the bet that he'll close this out without a court appearance.
Does anybody on this forum know if we have the option of submitting notes to
the court system in any way, stating our concerns and displeasure with Repak
prior to the next scheduled appearance?

Here's a link to another forum (Geocaching in the Buff) with some interesting discussion including an e-mail from the guy in response to contact from GeoLobo (Shane.)  I don't think violence on our part is the answer, or destroying his personal property, but I think a large presence in the court room would help send a message.  Note that in response to Geolobo, he does not admit guilt, so of coure he talks of "helping" and apparently he wants to help us for a fee. . . hahaha. .  .  The point is, we have him in an uncomfortable position with his family and peers, so whether or not the charges stick, I hope he decides to stop plundering caches, and wrecking our fun.  http://www.gitbuff.com/viewtopic.php?f=2&t=551

Whether or not this is actually a "crime" is debatable.  We geocachers are leaving
things behind in public areas.  We're walking away from them and are relinquishing
our rights to them, all on the expectation that nice people will find them and
follow the rules we've set up.  Technically, I'm not sure it's theft.

With that being said, there MAY be some other crimes that he can be charged
with, like being a public nuisance; don't know, since I'm not a lawyer.  At the
very least, I'm HOPING that he loses his security clearance at the lab.  To work
at AFRL's Information Directorate, he's almost certainly got a Top Secret
clearance. 

Lovely, eh?  Here's some SOB that takes a perverse delight in ruining other
people's good natured fun, all on the sly, while outwardly presenting himself
as an avid outdoorsman.  So what's he likely to do with gov't secrets?  Treat
them with any more respect?
